The Buyer is liable if they lack authority.

1. Subject and governing law

This agreement governs digital website setup, hosting, domain and admin panel services purchased remotely on ClubYol under Turkish Law No. 6502 and the Distance Contracts Regulation. No physical goods are sold; services are performed digitally, often immediately.

2. Pre-contract information

Before payment you receive: seller details, service description, annual price (VAT included), instalment surcharge if any, delivery process, withdrawal exceptions, refund policy (https://clubyol.com/en/delivery-returns), KVKK notice (https://clubyol.com/en/kvkk). You confirm by mandatory checkboxes at checkout.

3. Services and plans

4. Price, payment and invoicing

Annual subscription in TRY, VAT included. Payment via PayTR. 12-instalment option may add surcharge shown at checkout. No auto-provisioning before payment confirmation. Invoice based on your billing details — you are responsible for accuracy. We may use system logs, consent records and delivery emails as evidence in chargeback disputes.

5. Performance and delivery

Performance starts on payment approval (automated setup). Domain: typically 0–2h; site: 0–4h; DNS propagation: 2–48h (third-party). Delivery is deemed when automation starts and/or panel access is provided and/or domain is registered — whichever occurs first. Early-performance consent ends withdrawal right (Art. 9). INFRASTRUCTURE PROVIDERS AND TECHNICAL TRANSPARENCY The Seller delivers web hosting and domain services through established third-party infrastructure providers — not via servers the Seller operates. The Buyer acknowledges and accepts this arrangement. Web hosting: Provider: Vercel Inc. Website: vercel.com Headquarters: San Francisco, CA, USA Infrastructure: Europe (multi-region CDN, primarily Frankfurt) and global edge network Club websites run on Vercel's distributed cloud infrastructure. SSL certificates, CDN (content delivery network), automatic redundancy, and high availability are provided as standard by this infrastructure. The Seller does not operate its own hosting servers; this service is entirely provided by Vercel. Domain registration and DNS management: Provider: DomainNameAPI (operated by NetKA Bilişim A.Ş.) Website: domainnameapi.com Headquarters: Turkey Authority: ICANN-accredited and BTK/NIC.tr authorised domain registrar Domain registration and DNS routing (.com.tr, .org.tr and other extensions) is handled through DomainNameAPI's infrastructure. The Seller acts as an intermediary on the Buyer's behalf; domains are registered in DomainNameAPI's registry systems. Liability: Technical outages, DNS delays, or maintenance caused by the above providers are outside the Seller's direct control; the Seller shall not be liable for such events but will notify the Buyer. 6. Subscription, renewal and suspension

Annual model; no auto-renewal. Reminders may be sent 30 days before expiry. Non-payment may lead to suspension then takedown. Limited data retention after takedown; no refund for suspension due to non-payment.

7. Obligations

Seller targets: lawful service, reasonable support, reasonable security, notice of planned maintenance. Seller not liable for your content, third-party outages, DNS delays, force majeure or your errors. Buyer: accurate authorised data, lawful content, timely payment, password confidentiality, respect IP rights.

8. Intellectual property

Platform, themes and software remain our property or licensors'. You receive a non-exclusive, non-transferable licence for the subscription term only. No source code or infrastructure transfer on termination.

9. Right of withdrawal and early performance

General 14-day withdrawal under Turkish law — unless Distance Contracts Regulation Art. 15/ğ applies: digital services started with your explicit consent before the withdrawal period ends. At checkout you explicitly request immediate domain registration and site setup, accept instant digital performance and waive the 14-day withdrawal right. This is recorded electronically. Any rare applicable withdrawal must be in writing to destek@clubyol.com; refunds only as narrowly defined in our Delivery & Returns Policy.

10. Refunds and chargebacks

Rule: no refund after early-performance consent and service start. Exceptions, deductions (domain cost, setup fee, payment fees, instalment surcharge) and deadlines are in https://clubyol.com/en/delivery-returns. Unjustified chargebacks may lead to recovery of fees and account closure.

11. Limitation of liability

Maximum liability capped at the annual fee paid for the relevant period. No liability for indirect loss, lost profit, reputation or data loss if you did not backup. 99.5% uptime is a target, not a guarantee; planned maintenance and force majeure excluded.

12. Termination

You may stop using the service; no refund for used period. We may suspend/terminate for breach, non-payment or abuse.

13. Evidence

Electronic logs, emails/SMS, payment records and consent timestamps are agreed evidence under Turkish law.

14. Disputes

Consumer arbitration committees and consumer courts at your residence or where the transaction occurred. TÜBİS available.

15. Effect
